1.1 This quotation is valid for 28 days from the date of issue.
1.2 Exact colour matches cannot be guaranteed. Colours, paints, stains and textures may vary slightly from samples shown due to batch differences.
2.1 A 50% deposit is required before any order can be placed into production.
2.2 Once the order has entered production it cannot be cancelled.
2.3 If you cancel after the deposit has been paid but before production has commenced, the deposit is non-refundable.
2.4 The balance of the order must be paid in full the day prior to installation. Installation will not commence until the balance has been received.
2.5 If your order contains two or more different products (e.g. Shutters and Roller Blinds), we will notify you when each part of the order is ready. The balance for that part of the order is payable on the day of installation.
2.6 Once an installation date has been confirmed with you, if you cancel or postpone the installation on the day it is due (or with less than 24 hours’ notice), the full outstanding balance becomes due and payable within seven (7) days of the original installation date.
3.1 The supply of this order is subject to product availability. Approximate delivery times are estimates only and may be extended due to circumstances beyond our control. We are not liable for any delays caused by supply issues, freight, or manufacturer delays.
3.2 We will store your completed order free of charge for a maximum of 28 days from the date we notify you that it has arrived at our warehouse (unless a longer storage period has been arranged with us in writing beforehand). After this 28-day period, the full outstanding balance becomes due and payable, and storage fees may also apply.
4.1 You are responsible for the removal of any existing window coverings unless we have agreed in writing to remove them.
4.2 If we remove existing window coverings, we accept no responsibility for any damage to windows, paint, plaster or surrounding surfaces. We are not responsible for taking away the old window furnishings.
4.3 All blinds and shutters are manufactured square. We accept no responsibility for out-of-square windows.
4.4 You must ensure the work area is clear and safe for installation. If we are required to move furniture to access the windows, we accept no responsibility for any damage that may occur.
4.5 For external installations, you are responsible for ensuring the area is clear. We accept no responsibility for damage to trees, plants or landscaping.
4.6 Whilst all care is taken, we are not responsible for any unforeseen cracking or damage when drilling into tiles, bricks or concrete.
4.7 Whilst all care is taken, we are not responsible for damage to electrical wires, gas pipes, water pipes or telephone lines that may be located behind the fixing points.
4.8 Whilst all care is taken, we are not responsible for damage to flooring that occurs during installation where such damage is beyond our reasonable control.
4.9 If we attend site on the agreed installation date and are unable to complete the installation because the site is not ready (including but not limited to furniture not moved, access blocked, or wet areas unfinished), a re-attendance fee may apply.
4.10 You are responsible for arranging a licensed electrician for any motorised products that require hard wiring. We do not supply an electrician and do not cover their costs.
4.11 In the event that we cannot install your products on the booked day due to circumstances beyond our reasonable control (including but not limited to staff illness, vehicle breakdown, or other unforeseen operational issues), we are not liable for any losses, costs or compensation claimed by you, including time taken off work.
4.12 We do not provide temporary window coverings as a standard service if there is a delay, defect, or issue with your order. While we will always try to help find a practical short-term solution where possible, we are under no obligation to supply temporary blinds or shutters.
4.13 We are not liable for any claims for compensation, reimbursement, or damages arising from delays, rescheduling, measurement errors (including mismeasures by sales consultants or check measures by installers), or inconvenience caused by circumstances beyond our reasonable control. This includes (but is not limited to) staff illness, vehicle breakdown, supply delays, manufacturing issues, or the need to re-order products due to measurement discrepancies. Under the Australian Consumer Law, where a product has a fault or issue, we are entitled to the opportunity to repair or replace the product in the first instance. Customers are not entitled to compensation for time taken off work, including for any second or subsequent visits required to complete repairs, replacements, or adjustments.
4.14 We always aim to arrive within the time window given for your installation. However, due to the nature of our work, delays can and do occur from previous jobs (including unforeseen issues, traffic, or longer-than-expected installations). Customers should be aware that we may arrive earlier or later than the indicated time. While we make every effort to keep you informed, we are not liable for any inconvenience caused by arrival time variations.
4.15 If you believe the installation has not been completed to a reasonable industry standard, you must notify us in writing by email to admin@theshutterguy.com.au within seven (7) days of the installation date (or within seven days of us contacting you regarding completion). Failure to notify us within this period may affect your ability to claim under the installation warranty. Please note that “industry standard” refers to accepted trade practice, not personal preference.
5.1 All warranties begin on the day of installation and only take effect once the goods have been paid for in full.
5.2 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms of Sale is intended to exclude, restrict or modify those guarantees.

5.3 This warranty does not cover:
5.4 The warranty is valid only for the original purchaser and is not transferable.
5.5 If a product becomes faulty and cannot be repaired on site, we reserve the right to return it to the manufacturer. We are not responsible for providing temporary window coverings or for any consequential damage (including fading of furniture or flooring) during this period.
5.6 If the original product or fabric is no longer available, we reserve the right to replace it with the closest available match.
5.7 Please contact us as soon as any issue becomes apparent. Delaying notification may affect your warranty claim.
6.1 All invoices are due for payment as stated on the invoice and in these Terms of Sale.
6.2 If payment is not received by the due date, we will normally attempt to contact you by email and/or text message. We may also attempt to contact you by telephone. Please note that if our calls are not answered, this does not prevent us from continuing the recovery process.
6.3 If the outstanding amount remains unpaid after reasonable attempts to contact you, we reserve the right to issue a formal Letter of Demand.
6.4 If the outstanding amount remains unpaid after a Letter of Demand (or if we consider it necessary), we may refer the debt to a debt collection agency or solicitor without further notice.
6.5 In the event that the outstanding amount is placed with a debt collection agency or solicitor for recovery, all collection fees, legal costs, and disbursements reasonably incurred will be payable by the customer in addition to the outstanding balance.
6.6 We reserve the right to charge interest on overdue amounts at the rate permitted by law.
7.1 It is the customer’s responsibility to look after and maintain the products correctly after installation.
7.2 Products should be cleaned regularly using a suitable mild solution. If you are unsure of the correct cleaning method, please contact us in writing by email to admin@theshutterguy.com.au for advice before cleaning.
7.3 Outdoor products (including but not limited to external shutters, awnings, and roller shutters) must be washed down regularly, especially in coastal or high-salt areas, to prevent corrosion and deterioration.
7.4 Any issue or potential problem with the product must be reported to us as soon as possible and well before it becomes irreparable. Failure to maintain the product properly or to report issues promptly may affect your warranty claim.
